1. Notice-and-Takedown Overview
Camfanatics respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). We will respond promptly to valid DMCA takedown notices and take appropriate action to address claims of copyright infringement.
2. What a Valid DMCA Notice Must Contain
A complete DMCA notification must contain the following six elements required by 17 U.S.C. § 512(c)(3):
- (a) Your physical or electronic signature of the copyright owner or an agent authorised to act on behalf of the copyright owner;
- (b) A description or identification of the copyrighted work or works claimed to have been infringed;
- (c) A description and specific location (URL or sufficient detail) of the material on Camfanatics that you claim to be infringing, with enough detail to permit us to locate and identify the content;
- (d) Your contact information, including your name, address, telephone number, and email address;
- (e) A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law;
- (f) A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on behalf of the copyright owner.

Registration Notice: The Designated Agent is registered (or should be registered) with the U.S. Copyright Office and can be looked up in the official DMCA Designated Agents Directory at https://dmca.copyright.gov/.
3. Counter-Notification Procedure
If you believe that your content was removed by mistake or you were misidentified, you may submit a counter-notification to the Designated Agent. Your counter-notification must include:
- Your physical or electronic signature;
- Identification of the material that has been removed and its prior location on Camfanatics;
- A statement under penalty of perjury that you believe the removal was due to mistake or misidentification of the material to be removed;
- Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal district court in your jurisdiction;
- A statement that you consent to accept service of process from the person who provided the original DMCA notification.
4. Repeat-Infringer Policy
In accordance with 17 U.S.C. § 512(i), Camfanatics will terminate the accounts of users and creators who are determined to be repeat infringers of copyright laws in appropriate circumstances. We take intellectual property violations seriously and will exercise our discretion to remove access for users who repeatedly engage in infringing activity.
5. Good Faith & Penalty of Perjury
Misrepresentation in a DMCA notice or counter-notification may result in liability for damages under 17 U.S.C. § 512(f), including costs and attorney's fees. Claimants should carefully review whether content is actually infringing and whether they have the authority to send notices before submitting a claim.
