Terms of Service

1. Acceptance of Terms

By accessing or using Camfanatics (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, do not access or use the Service. These Terms constitute a legally binding agreement between you and Camfanatics.

2. Eligibility

Camfanatics is an adults-only platform. You must be at least 18 years of age to create an account or use any features of the Service. By creating an account or otherwise using the Service, you represent and warrant that you are 18 years of age or older. If we learn that a user is under 18, we will immediately terminate that account. We do not knowingly collect information from minors.

3. Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials, including your password. You are responsible for all activity that occurs under your account. You agree to notify us immediately at [email protected] of any unauthorised use of your account or any other security breach. We will not be liable for any loss or damage arising from your failure to safeguard your account credentials.

4. Creator and Fan Roles

Camfanatics supports two primary account types:

• Creators — Adult content creators who claim and manage their profile on the platform. Creators may post content, add a bio and avatar, link their third-party platform accounts, and engage with fans through the community features available to them.
• Fans — Users who follow creators, engage with creator posts, and participate in community features. Fan accounts do not have the ability to claim a creator profile.

Both account types are subject to these Terms and our Acceptable Use Policy.

5. Claiming a Profile

Unclaimed imported profiles may be claimed by the creator they represent through our claim flow. Claiming a profile requires identity verification to confirm you are the person depicted. Upon successful verification and claim, the profile becomes your managed profile and you assume full responsibility for all content associated with it. You represent and warrant that all content you post to your claimed profile complies with these Terms and applicable law.

6. Acceptable Use

You agree to comply with our Acceptable Use Policy, which is incorporated into these Terms by reference. The Acceptable Use Policy sets out the authoritative list of prohibited content and conduct on the platform. Violations may result in content removal, account suspension, or permanent termination.

7. User Content & Intellectual Property

Creators retain full ownership of the content they post to Camfanatics. By posting content, you grant Camfanatics a non-exclusive, worldwide, royalty-free, sublicensable licence to display, distribute, reproduce, and promote your content on the platform and in connection with the Service. This licence ends when you remove the content or close your account, subject to any retention periods required by law. Camfanatics does not claim ownership of any user-generated content.

You represent and warrant that you own or have all necessary rights to the content you post and that your content does not infringe any third-party intellectual property rights.

8. Unclaimed Profiles

Camfanatics sources publicly available profile data from adult platforms to build a creator discovery directory. Profiles that have not been claimed are labeled "unclaimed" and are presented solely as a public directory listing. Unclaimed profiles do not imply any endorsement of or relationship with Camfanatics. We do not claim that unclaimed individuals have agreed to these Terms or to being listed.

Creators may request removal of an unclaimed profile at any time via our opt-out / removal request form. We will process removal requests promptly.

9. Third-Party Links

Outbound links to third-party platforms route through our tracking path (/go/{short_code}) and record a click for analytics purposes. Camfanatics is not responsible for the content, privacy practices, or policies of any third-party platform. Links are provided for convenience only and do not constitute an endorsement of the linked platform or its content.

10. DMCA & Copyright

Camfanatics respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe content on the platform infringes your copyright, please see our DMCA & Copyright Policy for instructions on submitting a valid takedown notice to our Designated Agent.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. CAMFANATICS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CAMFANATICS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. IN NO EVENT SHALL CAMFANATICS'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) ONE HUNDRED US DOLLARS ($100) OR (B) THE AMOUNTS PAID BY YOU TO CAMFANATICS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to defend, indemnify, and hold harmless Camfanatics and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) your access to or use of the Service, (b) your violation of these Terms, (c) your violation of any third-party right, or (d) any content you post or transmit through the Service.

14. Termination & Suspension

We reserve the right to suspend or permanently terminate your account at our sole discretion, with or without notice, if we determine that you have violated these Terms, our Acceptable Use Policy, or any applicable law. You may also close your account at any time by contacting us. Termination does not affect any rights or obligations that arose before the termination date.

15. Governing Law

These Terms and any disputes arising out of or related to them or the Service shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict-of-law provisions. You agree to submit to the personal jurisdiction of the courts located in that jurisdiction for the resolution of any such disputes.

16. Changes to Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. If the changes are material, we will make reasonable efforts to notify registered users by email or via an in-app notice.
